Scalia: Does Torture Violate ‘Cruel And Unusual Punishment’ Provision? 'No.'

Last night, Supreme Court Justice Antonin Scalia granted his first broad-based television interview, to Lesley Stahl on CBS’s 60 Minutes. There he explained that the torture of detainees does not violate the 8th Amendment’s ban on “cruel and unusual punishment” because, according to Scalia, torture is not used as punishment:

On April 24, 2008, an anti-Iraq War rally was held in Baltimore City, at the War Memorial, directly opposite of City Hall. It was sponsored by , Progressive Maryland, and other pro-Peace groups. Why has the world sanctioned the systematic killing of the Palestinian people? Nearly six million Palestinians live in the geographic region called Israel. The 'Israeli Jews' alone have been granted a special license by a complacent world to brutalize, steal from, and commit mass murder against the Palestinian people. The Jewish soldiers and settlers beat, arrest, and kill innocent Palestinian men, women, and children almost daily. For the Indigenous Palestinians living in Gaza and the surrounding occupied territory its like living in a big Warsaw ghetto. The Palestinian's once lush and spacious homeland, hundreds of towns and villages, beautiful olive groves and farms have all been stolen or destroyed. Their world has shrunk to a few crowded slums and scraps of land.

According to eyewitnesses, the Ghalya family had gone to the beach earlier that day to have lunch and to swim. They decided to cut short their stay when artillery shells started landing on the beach in the distance. After a shell fell 300 to 500 meters away, `Ali `Isa Ghalya, the father, started to gather his two wives and their children near the road to the beach. They collected their belongings and called a taxi. When two more shells fell about 150 meters away, the men were sitting in one group on the beach, and the women in another. A fourth shell—the one that caused the casualties according to witnesses—exploded between the two groups but closer to the women. Eleven-year-old Huda saw that her mother was injured. “My mother told me to escape,” Huda told Human Rights Watch at the wake organized for her deceased family members. “I went to my father and then I started screaming.”

Freedom of Association:
Government may monitor religious and political institutions without suspecting criminal activity to assist terror investigations.

Freedom of Information:
Government has closed once public immigration hearings, has secretly detained hundreds of people without charges, and has encouraged bureaucrats to resist public records questions.

Freedom of Speech:
Government may prosecute librarians or keepers of any other records if they tell anyone that the government subpoenaed information related to a terror investigation.

Freedom From Unreasonable Searches:
Government may search and seize Americans’ papers and effects without probable cause to assist terror investigation.

Right to Legal Representation:
Government may monitor federal prison jailhouse conversations between attorneys and clients, and deny lawyers to Americans accused of crimes.

Right to remain silent when questioned by police:
The U.S. Supreme Court ruled that citizens no longer have the right to remain silent when questioned by police.

Right to a Speedy and Public Trial:
Government may jail Americans indefinitely without a trial.

Right to Liberty:
Americans may be jailed without being charged or being able to confront witnesses against them.

America is now the biggest debtor nation on earth, over ten trillion dollars, a debt so large that it is impossible to repay. Once the world understands this fact the value of the American dollar will tumble even more than it already has. The American dollar is printed by a privately owned non-government regulated bank. It is money that is not backed by gold or silver or anything of tangible value, its just paper. The presses are all working at top speed day and knight. The more they print the less its worth. The most interesting times are yet to come.

Customers demands for slave trade workers who do not have HIV or AIDS requires thousands of new victims each year. They trustingly come to Israel for honest work and are usually never heard from again.
